Plain Language Summary (TL;DR)

1. Acceptance of Terms

By accessing or using Poly-Puff (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service. These Terms constitute a legally binding agreement between you and Mark Middleton trading as Poly-Puff, based in Cape Town, South Africa.

These Terms were last updated on 29 April 2026 (Version 3.0). We will notify you of material changes by email. Continued use after changes constitutes acceptance.

2. Eligibility & Age Requirements

You must meet the minimum age requirement for your region to use Poly-Puff. Users below the regional threshold require verifiable parental or guardian consent. Please refer to our Privacy Policy for the full age gate table by region.

By creating an account, you confirm that you meet the age requirements applicable in your country or that a parent or guardian has provided consent on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@poly-puff.com if you suspect unauthorised access.

You may not create accounts for others without their permission, or create multiple accounts to circumvent usage limits.

4. Subscriptions & Billing

4.1 Free Tier

The free tier includes 10 exercises at no charge. No credit card is required to start.

4.2 Paid Subscriptions

Paid subscriptions (Pro and Classroom) are billed on a monthly or annual basis. Prices are displayed in USD by default. Current pricing is available at poly-puff.com/pricing.html.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive an email reminder before any annual renewal.

4.3 Cancellation

You may manage or cancel your subscription at any time through your billing portal. There are no cancellation fees. You retain access until the end of your current billing period unless Paddle or Poly-Puff confirms an immediate cancellation or refund.

4.4 Price Changes

We will give you at least 30 days' notice before any price increase. If you do not cancel before the new price takes effect, you will be charged at the new rate.

4.5 Taxes

Paddle, our payment processor, acts as Merchant of Record and handles all applicable taxes including VAT. South African users: prices include 15% VAT as required by SARS. International users: applicable local taxes are added at checkout by Paddle.

4.6 Mobile App Purchases

If you subscribe through the Google Play Store or Apple App Store, billing is governed by Google's or Apple's terms respectively. Poly-Puff does not process these payments directly.

5. AI-Generated Content

AI Transparency Disclosure (EU AI Act - Limited Risk): Poly-Puff uses artificial intelligence (OpenAI's API) to generate grammar feedback. All AI-generated responses are clearly labelled with an "AI" badge. AI feedback is educational guidance only - it does not constitute professional language certification or advice.

AI-generated grammar corrections may occasionally contain errors. Our database-first approach checks 340+ grammar rules before any AI call to minimise this, but no AI system is perfect. Always use your own judgement and consult qualified language professionals for formal assessment.

You may report inaccurate or culturally insensitive AI feedback using the Report button on any AI response. All reports are reviewed by our team.

6. Intellectual Property

6.1 Our Content

The Poly-Puff app, website, logo, grammar database, and all associated content are owned by Mark Middleton and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of any original content you create within the app (e.g. your translated sentences). By using the Service, you grant us a limited licence to process your content solely to provide the Service to you.

6.3 AI-Generated Responses

AI-generated feedback produced by the Service in response to your exercises is provided for educational use. Note that under Ukraine's copyright framework, AI-generated works may be subject to a 25-year sui generis protection period.

8. Availability & Disclaimer

We aim for high availability but do not guarantee uninterrupted access to the Service. The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.

AI grammar feedback is provided for educational purposes only. We do not warrant that feedback is always accurate, complete, or suitable for formal assessment purposes.

9. Limitation of Liability

To the maximum extent permitted by South African law and applicable international law, Poly-Puff's total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, or consequential damages including loss of learning progress, data, or revenue.

10. Third-Party Services

The Service integrates with third-party services including OpenAI (AI processing), Paddle (payments), Google, Apple, and Facebook (optional sign-in). Your use of these services is subject to their respective terms and privacy policies. Links: OpenAI Terms · Paddle Terms.

11. Termination

You may delete your account at any time at poly-puff.com/delete-account.html. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall first be attempted to be resolved informally by contacting us at support@poly-puff.com. If unresolved, disputes shall be subject to the jurisdiction of the South African courts.

EU and UK users retain the right to bring claims before their local courts and applicable consumer protection bodies regardless of this clause.

13. Consumer Rights (UK & EU)

If you are a consumer in the UK or EU, you have statutory rights including the right to a 14-day cooling-off period for digital subscriptions, subject to you not having already accessed the digital content. Our 7-day money-back guarantee (see Refund Policy) is in addition to, not instead of, these statutory rights.
